The Next Step


   Despite the voices of more than fifty people, on the night of November 9th the HOA Board of Tivoli Village passed a 15% increase to the association dues for 2010. Kyle Sanders, the association president, sat with Diane Hilt-Hicks at the front of the room with board secretary Peggy Jensen in attendance via the telephone.
   Sanders called the meeting to order and opened the floor for comments, questions and concerns. Resident Tom Beard read a prepared statement, speaking for the residents in attendance and many others there in spirit. Beard shared the belief that the HOA board and its management company, Sentry, had created a breach of contract and because of that breach the residents would pay the 2009 fees again in 2010 no matter the vote of the board. Beard also pointed out that because this budget meeting was not announced in the format required by the community's by-laws nothing agreed to on Monday would be binding. For another hour residents and the board discussed places to cut budget expenses, the reason for increases to our budget and ways to collect owed money. Amongst these many topics a lengthy discussion detailed a receivership program where renters of units in arrears would pay their rent check to our accociation until their owed amount was paid in full and the potential of foreclosures on empty units that are in arrears.
   After close to 60 minutes of discussion Sanders answered a question that caused most in attendance to stand up and leave. The less than ten people that remained were witness to the board voting to go ahead with the increase in dues. After the vote Channel 35 interviewed Sanders and Beard.
   As a follow up, despite Sanders stating the association attorney recommended not doing a receivership process, this funds retrieval program was implemented with hopes of getting some of the owed money back into the association within the next few months. We are wanting to purchase a home in this neighborhood and am wanting to know what the HOA fee includes, other than exterior maintenance and landscaping. Are any utilities (cable, internet, water) included in the fee?

According to documentation our hoa is to pay for insurance on the outside of the building, maintenance both for lawn and our pool and basic other stuff to keep our development looking nice. No utilities are included. For more information you can contact Sentry Management who is our property manager.
