WOW ... has some stuff happened ...


   Since our "interesting" budget meeting last month a lot has happened. On the Monday before Thanksgiving members of the Transition Team and community residents went to the Sentry Management office to look through our community files and scanned several months of financial statements amongst other things. We have only just begun to go through this information but have it in case we need it for our attorney.
   Speaking of attorney, members of the Transition Team are working with the Orange County Bar Association to select a small group of board certified attorneys to interview. If you are interested in being apart of the interview process please e-mail any member of the Transition Team and you will be brought in on the process. Our goal is to have an attorney selected by the end of January. By then we should know what fees are and a plan of attack in the breach of contract suit.
   You should have received a note from Sentry Management and Mr. Kyle Sanders dated November 10th. In the letter Mr. Sanders does a fantastic job of outlining the financial position of our sub-division from his point of view. He does not mention that he has yet to pay one dollar towards the deficit he owes per our contract. He neglected to mention that part of the reason we are so much in arrears is Sentry Mangements delay in going after residents that owed thousands of dollars years ago. Mr. Sanders actually has the audacity to write, "The current budget would be at or near break even if everyone contributed in accordance with their legal obligations." Mr. Sanders has yet to do that and thus the reason for our lawsuit against him and his company.
   One final thing, Diane Hilt-Hicks is no longer our property manger. As I am confident this will make some people happy please do not forget that much of what we know about Sentry and Mr. Sanders is because of her efforts. Make sure you get an opinion about whether the developer will be able to use the HOA funds to defend any lawsuits. I believe he will be able to and pass all his legal costs back to the homeowners. Some owners may not join your lawsuit, but still be obligated to pay for the association's defense. That's not such a good scenario, is it?
