
More than 75% of you have voiced your support for fencing in our back yard. With such a resounding message being sent we will reach out to Sentry Management and let them know we are ready to have fences installed. For those of you worried about privacy fences please understand these will not be installed. A short, metal fence as pictured above, is what we will propose. These fences will only be allowed to go between units and extend from the back wall for a distance of 24 feet. BEFORE any fence can be installed it must have ARB approval and must be installed by the community approved company that has yet to be determined.
63% of you have also approved the offer made by Curtis Security. Curtis has offered to patrol our common areas, monitor residents vehicles and supply vehicle tags. Curtis could also be paid to provide individual protection for your home for a minor fee. We will also inform Sentry Management of your wishes with this matter.

You knew when you moved in that they were not permitted. If you wanted a fenced in yard you should have bought a house not a town home. In the survey you can vote multiple times as the counter doesn't prohibit a person from voting multible times so the results are skewed and not a true representation of the community at large. I would pursue legal options if fences are permitted in the community.
When we moved into Tivoli Village homes here selling in the mid 200's. When we moved into Tivoli Village no one spoke about the Pinecastle Jeep Range. When we moved into Tivoli Village Cambridge Homes was the only builder here. When we moved into Tivoli Village owners paid their HOA dues ... My point is as time passes circumstances change. People that wished to live in a town home for a short period of time find themselves here for an extended period of time and it is that need, that want that has pusheed for a fence.
The fence already agreed on by our HOA's ARB is not a privacy fence or one that encloses an area, it just a division between properties to allow residents the feel of a home in a town home development.
Yes, the survey could have been skewed but it also may not of. Personally, I don't have the time to spend voting and voting again and again. I voted once and moved on and I choose to believe my neighbors did the same thing.
You are obviously free to pursue any legal action that you like. That is the wonderful part of being here in the United States. Before you do though I recommend you read our HOA By-Laws and comprehend the powers of the ARB to make changes in Tivoli Village.
Finally, although I do appreciate your reading our blog and your input I ask that you identify yourself, especially when your post is threatening in nature. We have a great neighborhood because of our neighbors. Living so close to each other we will not always agree with so it is vital to have open dialogue in order to find the compromises that will allow this community to continue to be the wonderful place it is today.

If we are approved to move forward with the fence...how will the landscapers enter each area that is fenced in...will that area become the owners responsibilty to upkeep? Also, In my personal opinion I think we should work on fencing in the development as a whole. The backside of Caramella Drive is still wide open...as an end unit owner would we be able to fence in our enitre yard...since our yards are not only the back of the unit. Would the end unit owners be allowed to fence in there full property line?

The fence is not a privacy fence or one that encloses anything. It is one that will come out 24 feet from the back of your place, separating you and your neighbor. It is NOT required but something open for residents to try if they want.
That being said, I could not agree with you more about the fencing. Unfortunately the developer is not going to finish that off and we as a community dont have the money. We are very much still in the red and until that problem is fixed extra things are on hold. Well, unless we can apply and receive a grant from the city to improve our development.

We also only voted once..We are also sure that our neighbors only cast their vote one time..We also want to commend you Tom,we know how busy you are and still continue to take the time to maintain an informative media for the Community through Tivoli News.
Will ther be a impact on lawn maintenance fees? having fences will increase the labor cause ther will be a lot of string trimming to be done with fences in our backyards. Also I thought it was in our bylaws that no comercial vehicles, work vehicles, or vehicles with wording were allowed. Why is Curtis security exempt from this? Is it cause they offered to provide a free service that they will benefit from. I want to be exempt also for the retaining bricks I put around my tree in front this was done cause of the excellent landscaping we get .
We should have fences! Our yards are wasted space without them. We need the boundries in order to keep people out of our properties.
We are stuck here, might as well make the best of it and enjoy our little yards!

The reason Curtis Security is exempt from the No Commercial Vehicle Regulation is because like a Police vehicle it is helpful in crime prevention for our Community.
